Sex assault trial set to start more than a year after complainant's death

BARRIE, Ont. — A man accused of sexually assaulting a young Ontario woman as she slept is set to face trial today, more than a year after the woman took her own life.

Shawn Roy’s trial was initially scheduled to begin last Thursday but was postponed so he and his lawyer could review their approach after a judge ruled that statements the woman made to police and friends would be admitted as evidence.

Court documents show Kassidi Coyle — who the judge identified only as K.C. — told friends and investigators she woke up at a friend’s house on July 1 of last year and realized there was someone in bed with her.

Coyle, 20, told them she felt someone try to penetrate her and jumped out of bed, then she saw Roy and noticed her underwear and shorts on the floor.

The documents show Roy’s lawyer sought to have the statements excluded because Coyle can’t be cross-examined, and suggested she may have misperceived what happened.

The identity of sexual assault complainants is typically protected by a publication ban but Coyle’s family has said they fought so that her name could be made public.
