CHANDIGARH: Punjab Inspector-General of Police Ajay Kumar Pandey, who has been charged in a case of alleged kidnapping that was registered in Jammu, finally got the English version of the charge sheet filed by the Jammu and Kashmir Police on Tuesday after 26 long years.
The Punjab IGP, Human Rights, was booked in July 1990 while he was posted in Jammu and Kashmir on complaint of a victim's family who alleged their son was among people kidnapped and detained by the J&K Police in the Baramulla district. The man never returned home after that. Pandey was booked under Sections 364 and 344 of the Ranbir Penal Code and the charge sheet was first filed in 1991, but in Urdu.
The case against Pandey was booked in Jammu, but the Supreme Court shifted it to Chandigarh district court after the police officer in 2011 moved an application, mentioning risk to his life in Jammu and Kashmir.
On Tuesday, Pandey got the English translation of the charge sheet that was originally filed in Urdu. A special prosecutor from Jammu translated the charge sheet in English and submitted it in English to the Chandigarh court where the trial will be held.
The charge sheet was submitted under Sections 364 (kidnapping or abducting in order to murder) and 344 (wrongful confinement for 10 or more days) of the Ranbir Penal Code. The J&K Police has included 25 witnesses in the charge sheet, including the complainant and family members of the missing man and people from their village in Baramulla district, where the alleged kidnapping took place.
The Chandigarh district court had earlier issued a letter to the legal department of Jammu and Kashmir, urging it to send a counsel to assist the court in the case as all the documents provided for the trial were in Urdu. The court said it was not getting a chance to start the trial due to these problems.
The Ranbir Penal Code is a criminal code applicable in Jammu and Kashmir as IPC is not applicable in the state under Article 370 of the Constitution. The code was introduced during the reign of the Dogra dynasty and was compiled on the lines of the Indian Penal Code.
