Take action against erring officials for ‘illegal’ appointments: Expert

GAYA: Hailing Magadh University (MU) decision to do away with daily wage and contract appointees, Nageshwar Sharma, former director, higher education and an expert of university laws, has demanded action against officials who made illegal appointments.

According to Sharma, mere removal of daily wage and contract employees engaged against non-sanctioned post was not enough. Those who made such appointments are bigger culprits and the VC should identify the wrong doers and take action against them.

According to Sharma, as per law, those causing loss of public money through illegal appointments deserved penal action. Besides action, those making illegal appointments should compensate the loss caused to the public exchequer by their wrongful actions. The VC has the power to invoke the provisions of Public Demand Recovery Act to realise the money paid to illegal appointees.

Sharma also wanted the VC to sympathetically consider the candidature of retrenched staff members during fresh recruitment and accommodate the qualified and deserving candidates. All appointments in future should be made strictly in accordance with the law in a transparent manner only against posts sanctioned by the government.


Referring to earlier appointments, Sharma said any appointment made against non-sanctioned posts in violation of reservation rules and without giving chance to all eligible candidates was illegal ab initio (from the very beginning).


Meanwhile, virtually shell shocked by the university's tough stand against the demand for service regularisation of the daily wage and contract employees, the Non-teaching Employees' Union mulls legal fight to challenge the termination order of nearly 200 employees. Though union president Akshay Kumar could not be contacted, sources say that the union leaders seriously contemplate seeking court's intervention.


Meanwhile, PG Teachers' Association president Sunil Singh has said that Non-teaching Employees Union and university authorities should sit together and reach for a negotiated settlement.
