Student moves high court on controversial ordinance

Jodhpur: A student has approached the Rajasthan High Court challenging the rejection of his ishtgasa (complaint-petition) filed under CrPC section 156(3) by a magisterial court citing the state government's controversial ordinance that shields judges and public servants. The student's plea is yet to come up for hearing at the high court's principal seat here.

The ordinance promulgated on September 7 and tabled in the state assembly on October 23 will lapse on December 4. It requires judicial magistrates to seek government approval before taking cognisance against former and sitting judges and public servants on complaints filed against CrPC section 156(3). The ordinance further provisions a jail term of up to two years for media persons who publish or broadcast such complaints where government approval is still pending.

The latest petition challenging the ordinance has been filed by Ganpat Singh, a student of Government P G College at Devgarh, allegedly that he was detained illegally and beaten by the police on September 22. Singh's counsel S P Sharma said the petitioner got no relief from the state human rights commission either.

Another petition, filed by one Aijaz Ahmed, challenging the controversial ordinance is already being heard by the high court here.


The state government had argued in court that Ahmed had no locus standi in the matter since he was not directly affected by the ordinance. The second petitioner, Ganpat Singh, has now claimed that he is directly affected by the ordinance.


The petition by Ahmed is scheduled for another hearing on December 5, while the petition by Singh is yet to be listed for hearing.


The government had told the high court that the state assembly's select committee that was constituted to review a bill on replacing the ordinance is scheduled to meet on December 4.
