BMW murder: ‘Accused kept exiting, entering cafe’

CHANDIGARH: An eyewitness to the February 8 night murder of Akansh Sen, a nephew of Himachal Pradesh chief minister Virbhadra Singh, said in court on Wednesday that the accused duo, Balraj Singh Randhawa and Harmehtab Singh Rarewala alias Farid, kept entering and exiting the Sector 9 cafe where they were drinking before they allegedly carried out the crime.

Adamya Singh Rathore, the complainant in the murder case and a cousin of Akansh Sen, recorded his statement before the court of additional district and sessions judge J S Sidhu for the first time on Wednesday. Adamya answered questions posed by the prosecution and will now be cross-examined by Farid's lawyer on the next date of hearing.

The medical superintendent of PGIMER also appeared with all medical details of the case. However, one eyewitness, Karanyog, could not appeat in court due to ill health. Narrating the sequence of events, Rathore said Randhawa ran the car over Akansh thrice in front of their common friend Deep Sidhu's Sector 9 house, while Farid, who was sitting in the passenger seat, instigated him to finish the victim.


A cousin of Akansh, Adamya had filed the complaint with police, claiming that his cousin and business partner, co-owner of Boombox Cafe, was hit intentionally by Randhawa, who drove a BMW over. A group of friends had got together at Boombox Cafe that night, after which some of them went to Deep's house, he said. He added that an altercation occurred between Shera, another friend, and Harmehtab due to a previous enmity, which ultimately resulted in the incident.


Rathore was also cross-examined by defence counsel A S Sukhija, who questioned him about the presence of friends, the amount they all drank that night among other things. When asked about the presence of girls that night, Rathore said there were three, of which he knew one. Elaborating on the amount he drank, Rathore said he only took a sip after Shera and other friends insisted. He stated that he couldn't recall the brand of alcohol, except that it was vodka. He added that Balraj and Harmehtab were among those who kept going outside and coming back to the cafe. When asked why four people took an injured Akansh to hospital, Rathore said they did it to avoid any dispute.


He also mentioned that they did not get any formal entry made at the PGIMER while getting his cousin admitted. While Randhawa is yet to be arrested, charges against Harmehtab were framed under sections 302 (murder) and 34 (acts done by several persons in furtherance of common intention) of the IPC. The challan was presented in June. Police have named an award between Rs 50,000 and Rs 1 lakh for any information on Randhawa, who is still at large.
