Merc driver gets bail 2 days after crushing 4-year-old, family cries foul

GURUGRAM: The man, who was behind the wheel of the Mercedes that crushed four-year-old Devika to death in old Gurgaon and was subsequently arrested for rash driving on Sunday, walked free on Tuesday, triggering outrage in the Sector 12 slum where the little girl lived.

The relatives and neighbours were still mourning Devika's death and her mother Jyoti was still inconsolable, when they came to know that the driver, Sunil Kumar, was granted bail by court.

Police said he was booked under sections 279 (rash driving) and 304A (death by negligence) of the IPC, both bailable sections.


Two days ago in the afternoon, Devika was walking with elder sister Sarika (6) along the road in Sector 12 when the white Mercedes came speeding from behind. While Sarika fell on the roadside and had a close shave, the younger sister came under the wheels and succumbed to her injuries soon after, claimed eye-witnesses. A few years ago, Sarika was hit by a speeding car at the same spot. Fortunately, she had survived with a mild fracture. "The car was moving at a very high speed. The driver and another person travelling in the car tried to flee after knocking down Devika. However, local shopkeepers caught hold of them and forced them to take the girl to hospital. But it was too late," said Kaloo Devi, Devika's aunt. The aunt further said it had been two days but there hadn't been any significant development in the case. "The police have got the car's number, so tracing down the owner should not be very difficult. The driver, who was arrested, has also got a bail," she rued.


Devika's father Vicky was at work when he heard about the accident and rushed to the civil hospital. "I was told that my daughter was fine so that I would not create any drama. But soon I found out that she had passed away," he said, taking out his mobile phone to show her daughter's pictures.


"We know that the car belongs to a politically connected person and it will not be easy to bring him to book. But, we will do whatever we can to get Devika justice," said the bereaved father. Police said the car owner had not been identified as the driver failed to provide the registration certificate (RC). "The driver was granted bail by court as it is a bailable offence," said Narpat Singh, the investigating officer. He said that Raj Kumar had appeared in court on behalf of the owner.


However, the police have added sections 49 and 192 of the Motor Vehicle Act to the FIR after the driver could not produce the RC.
