PUNE: The parents of a 19-year-old who was killed in a road accident in June 2010 were granted damages to the tune of Rs8.4 lakh by a motor accident claims tribunal.
The tribunal has directed the owner and the insurer of a light commercial vehicle (LCV) to jointly pay the compensation, along with 9% annual interest since August 30, 2010, to the parents of the industrial supervisor, who died in the accident at Kharabwadi on Talegaon Dabhade Road.
The interest component so far works out to Rs5.38 lakh, and will continue to increase till the actual payment is made.
"The parents had filed a claim for Rs4 lakh, but the tribunal, after going through the pleadings and appreciating the evidence on record, applied the principle of just compensation as laid down by the Supreme Court to grant the enhanced compensation. The petitioners have to furnish the remainder of the court fees to secure the enhanced compensation amount," lawyer K K Bandal, who represented the petitioners, told TOI.
Shivaji Tukaram Patare of Chimbli Mazgaon, in Khed taluka, was riding his motorcycle from Chakan-Talegaon Dabhade Road to Nanegaon, when a rashly driven LCV hit his bike on the midnight of June 11, 2010. Patare died on the spot of multiple injuries.
The Chakan police then registered an offence against the driver of the vehicle, owned by Ashok S Bangude of Andesne village in Mulshi taluka. The vehicle was insured by Shriram General Insurance Company Limited.
On August 30, 2010, the victim's parents — Tukaram Ganpat Patare (50) and Kamlabai (44) — filed a petition before the MACT, seeking compensation from the owner and the insurer. The matter was heard by tribunal member S H Gwalani, who pronounced the judgment on Monday.
The tribunal held that the oral evidence by Tukaram was supported by the police probe papers. The evidence went unrebutted by the respondents (LCV owner and insurer), it observed.
