Builder’s flip-flop on payment date ‘inflates instalment’

GURUGRAM: Homebuyers who have invested in NBCC Heights are miffed at the developer for its flip-flop on the date for payment of the last instalment, thereby impeding the possession of flats.

First, they had, around three years ago, arbitrarily deferred the payment for an indefinite period and then, last month, they suddenly asked the buyers to clear their dues within a month's time, the buyers claimed. They alleged that they now have to pay an increased amount as their last instalment due to GST.

NBCC Heights, a residential project, was launched in 2011, especially for central government employees, by public sector real estate company National Buildings Construction Corporation (NBCC) built.


The project has around 11 towers and 450 flats is built on 11 acres in Sector 89 . On Saturday, around 30 buyers, all central government employees from different parts of the country held a meeting with senior officials of NBCC. The aggrieved buyers told TOI the meeting was fixed after intense persuasion for nearly one and a half year as NBCC was aloof to their complaints so far.


"We were supposed to submit the amount in six instalments," said Randhir Singh Redhu, the RWA president of NBCC Heights Sector 89. "Our last instalment was on December 30, 2014, but on December 26, a week before the final date, we received a letter from NBCC telling us that the date of submission has been deferred indefinitely." Buyers are complaining that they were shocked after NBCC informed them on October 4 recently, three years after the December letter, that they will have to pay the last instalment within a months' time or else an interest of 12% for the late payment would be levied.


"First they deferred it arbitrarily," said Pramod Kumar Juneja. "Now they have suddenly issued a new deadline and are threatening us to levy interest if we don't pay on time. Worse yet, due to the implementation of GST, the new last payment amount has risen exorbitantly. As on December 30, 2014, I was supposed to pay Rs4,96,000 as the final instalment. Now, after getting the letter on October 4, I paid Rs5,28,000 because and I was forced to pay it. What is the point of having to pay the money in instalments then?"


Redhu said that project should have been completed by 2014, "Even now, the October 4 letter has been sent only to 150 buyers out of 450," said Juneja. TOI spoke to chief general manager NBCC Reshma Dudani who was part of Saturday's meeting. "I am sorry I cannot say anything at the moment. I can only speak on Monday," she said.
