Indore: Property buyers can approach police against errant builders: RERA chairman

Indore: Newly-constituted Real Estate Regulatory Authority (RERA) chairman Anthony J. De Sa said that the authority aims at regulating the sector. However, if a builder runs away than those who have booked flats can approach the police. “RERA is not to punish people but to promote the sector and protect the people’ he said.
He was addressing a seminar of chartered accountants and builders organized by local chapter of The Institute of Chartered Accountants of India (ICAI) at its auditorium on Tuesday. Former chief secretary of the state De Sa also clarified issues related to builders and buyers, including possession, maintenance charges, completion certificate and agents fee.
He said that transparency and equal opportunity for everyone was the basic objective of the Regulator. RERA would ensure implementation of regulation. Applauding real estate sector, he said that the sector was essential to ensure house for all. Government agencies alone cannot meet the demand, he added.
He said that RERA not only deals with cases registered under section-3 of the RERA Act but can also hear cases of unregistered properties under Section-2 of the Act. On builders facing problem in getting completion certificate (CC) of project despite complying with all requirements, he said, “We have recommended phase wise CC issuance. He said that there was a provision of demand certificate in Nagar Palika Act too.
He further clarified that if a builder submits a CC application and does not receive any notice from the municipal corporation then it be deemed as CC.
As per RERA proposal sent to state government two CCs can be issued, first at completion of infrastructure work and second at completion of the project. In fact, RERA wants to make receiving of CC easier. Earlier, CA Vishnu Agrawal, described role, objective, functioning and provisions of RERA Act through a power point presentation. He also raised certain issues of mortgaging plots and flats and effectively pitched for provisional ease from RERA.
