JAIPUR: A petition has been filed before the Rajasthan High Court challenging Rajasthan Backward Classes (reservation of seats in educational institutions in the state and appointment and postings in services under the state) Bill, 2017.
The Bill was passed recently by the assembly raising OBC quota in the state from 21% to 26%.
The Bill had a provision of 5% quota within the OBC under the More Backward Classes to Gurjars and four other castes raising the total reservation in the state to 54%.
The division bench of Justice K S Jhaveri and V K Vyas issued notice to the chief secretary, additional chief secretary, social justice and empowerment, and principal secretary, the department of personnel, in the case. The petition has been filed by one Ganga Sahai Sharma. The matter has been posted for further hearing on November 13.
G P Kaushik, counsel for the petitioner, said the Supreme Court had ordered the government to maintain status quo on a special leave petition (SLP) filed in the apex court after the high court struck down the special backward classes (SBC) quota of 5% for Gurjars and four other castes under OBC in 2015. The petitioner argued that the new legislation by the government is contempt of the apex court order.
The high court had struck down the SBC quota on the ground that with this additional quota of 5%, reservation in the state went up to 55% which violated the ceiling set by the Supreme Court for reservation at 50%.
