Withdraw stir: RHRC to docs

Jaipur: The Rajasthan Human Rights Commission (RHRC) has ordered the agitating doctors and their organization to withdraw strike forthwith and return to work in accordance with the Supreme Court and high court orders.

The commission order follows a petition by lawyer Abhinav Sharma who had also filed a contempt petition against the striking doctors in the high court on Wednesday.

The commission reiterated that doctors should not use the hapless patients as a bargaining chip. The doctors should use their right to protest as a last resort and asked the union leaders to present their reply on November 10.

The commission said, the doctors' strike is in direct conflict with the right to life guaranteed under Section 144 of the Constitution.


The commission chairman Justice Prakash Tatia asked the Medial Council of Rajasthan (MCR) to put forward its views on ongoing in-service doctors' strike. It asked the MCR to make its stand clear what action it could take against a doctor, whether government or private, who fails to discharge his duty where the patient was not at fault.


Has the MCR taken any action against a doctor on similar ground in the past? The MCR was asked to give its opinion on this issue earlier also but the why it has failed to comply with the order, asked the commission.


The commission also asked the principal secretaries of Medical Education and Medical and Health why it failed to stop a state wide agitation by the doctors and what alternative measures were put in place for the care of the patients. It also asked the government explain the reasons for the widespread discontentment among the doctors leading to such a huge protest.
