AHMEDABAD: The Gujarat high court is to decide whether forcing the wife to perform oral sex was sodomy, rape or marital cruelty, and if a man could be tried on these charges.
Hearing a man's plea for the quashing of an FIR filed against him on his wife's complaint, Justice J B Pardiwala sought on Monday the state government's exaplanation on the IPC sections applicable, and also issued notice to the woman.
The husband has argued that his action could not qualify as rape or sodomy because they were a married couple. Justice Pardiwala also expressed concern about marital rape, saying it was a "disgraceful offence".
