Nagpur: In a respite to BJP corporator Lakshmi Yadav, wife of Maharashtra State Construction Workers' Welfare Board chairman Omprakash Munna Yadav, the Nagpur bench of Bombay High Court on Tuesday granted her ad-interim protection from arrest.
A single-judge bench comprising justice Atul Chandurkar, however, denied similar protection to her sons — Karan and Munna, after the prose)Ocution insisted on their custodial interrogation for further investigation of the offences, including attempt to murder. While issuing notice to state through Dhantoli police station, the court asked it to reply before November 7, fixed as next hearing date.
The police were directed to release petitioner Lakshmi on bail, in case she was arrested, on furnishing a personal bond of Rs20,000 and one surety of the like amount. The corporator from Ajni Ward was also told to attend the police station on Thursday between 11am to 1pm, and act as per the directions of the investigation officer.
Justice Chandurkar further warned her against taking any steps to influence prosecution witnesses.
A battery of lawyers led by senior counsel Sunil Manohar, Uday Dable, Nikhil Gaikwad, and Akash Gupta represented the accused trio while additional public prosecutor KL Dharmadhikari waived notice for the government in two applications for anticipatory bail filed by the petitioners.
The trio approached the judiciary seeking anticipatory bail in the attempt to murder case registered against them after a clash with relatives led by Mangal Yadav on October 21. On Friday, the petitioners' anticipatory bail plea was rejected by district and additional sessions judge TS Akali, stating that their custodial interrogation was vital for further investigation.
'Munna Yadav's anticipatory bail plea soon'
Uday Dable told TOI that he would be filing anticipatory bail plea for Munna Yadav, a close aide of CM Devendra Fadnavis, who is absconding since the incident. "I will move applications for Munna and brother Bala Yadav in a couple of days in front of the sessions court here." The entire family of Munna Yadav was booked under various sections of IPC for allegedly attacking Mangal, Papa and Gabbar Yadav, their sister Manju, and others, near Ajni Chowk over a dispute on bursting firecrackers.
