Akansh sen murder case: Court to frame charges on October 27

The court scheduled the hearing for framing of charges on October 27. On Tuesday, arguments were exchanged in the court between the defense of Harmehtab Singh and prosecution in Akansh Sen murder case.

“Harmehtab alias Farid provoked BMW car driver Balraj Randhawa to hit and kill Akansh Sen,” argued the prosecution in court on framing charges against Harmehtab under Section 302. The defense, in reply, stated that “none of the reports confirmed it and it was not a case of intentional murder”.

The court scheduled the hearing for framing of charges on October 27. On Tuesday, arguments were exchanged in the court between the defense of Harmehtab Singh and prosecution in Akansh Sen murder case.

From the defense, advocate A S Sukhija argumed that section 302 (murder) must be dropped and instead it should be replaced with section 304 (culpable homicide not amounting to murder).

The prosecution stated that after Balraj hit Sen with the BMW car and Harmehtab asked him to run him over again as he was not dead yet. However, the defence argued that it was a case of accident as there was no motive of intentional murder and since the youths were heavily drunk at the time, there was no possibility that anyone could have heard as how Harmehtab instigated Balraj. However, the prosecution took up the statement of Shera and established that there was old enmity between Shera and Harmehtab which led to the incident.

Sukhija also argued that if this was the case, why they did not ensure that Sen had died. Akansh had succumbed to injuries later at the PGIMER and had not died on the spot. Sukhija added that no one knew how Sen died as he could have also died due to improper treatment at hospital.

As per official records, after the DNA and CFSL reports arrived, the PGI team issued another report and gave its opinion that the cause of death was falling on the ground after being hit by a car.

No results from CFSL report on BMW car

The CFSL report on BMW car which was reportedly used in the crime, has no positive report. The CFSL report states that the blood samples on BMW are not clear and nothing could be acertained from it as whose blood samples were those.
