Single judge order against actor Kajal stayed

CHENNAI: A division bench of the Madras High Court has stayed the operation of an order of a single judge dismissing actor Kajal Aggarwal’s plea for a directive to cooking oil major VVD & Sons to pay `2.50 crore towards damages for using her advertisement profiles unauthorisedly beyond the contract period.

A bench of Justices Rajiv Shakder and N Sathishkumar granted the injunction while passing interim orders on an appeal from the actor challenging the order of the single judge, on Tuesday.
 “In spite of notice given to the respondent (VVD Oils) it had not chosen to appear. Interim injunction granted till the disposal of the Original Side Appeal,” the bench said.

The actor, apart from seeking to set aside the order of the single judge, also sought for an interim injunction restraining cooking oil major VVD & Sons from using her profile for its business advertisements in any manner, whether through pamphlets or any kind of business promotion or through cinematography material.

Kajal contended that the single judge had failed to understand the question involved - misuse of her profile beyond the permitted period of contract. He had failed to understand that the copyright is applicable only to third parties and to the world.
