KOCHI: The Kerala High Court on Wednesday observed that there was no material for slapping a charge of outraging the modesty of women in a complaint filed by three women against an Uber taxi driver, who has accused them of assaulting him.
Disposing of an anticipatory bail petition filed by the driver T.I. Shefique, the court observed that the petitioner did not have to fear about his arrest as only bailable offences could be charged against him.
The court, while criticising the police for charging the driver with the offence under Section 354 (outraging the modesty of a woman) of the Indian Penal Code, said that there was no material in the complaint for constituting such an offence. The court said that it failed to understand why these offences had been included in the FIR. It added that if the petitioner was arrested, he could move the magistrate court concerned and get bail from there.
