Why was FIR issued against Sircilla SP & others: HC asks State government

HYDERABAD: Hearing the case related to the torture of youth by Nerella police, Hyderabad High Court on Tuesday asked the Telangana government to explain to it why a FIR was not issued against the Superintendent of Police (SP) of Rajanna Sircilla district, sub-inspector of Nerella and 18 police personnel, who allegedly tortured the youth.A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice G Ganga Rao was dealing with a PIL by Gaddam Lakshman, president of civil liberties committee, seeking to order probe through either CBI or SIT into the alleged torture of eight persons belonging to SC and BC communities by the police at Nerella village in Sircilla district. The case was also taken up on the incident based on letter of former judge Justice B Chandra Kumar.

Petitioners counsel V Raghunath told the court that the victims have lodged complaint with the DGP against the police officers responsible for the torture and the victims also deposed statement before the inspector general of police concerned against the police officers and personnel involved the torture.
Despite the statement and complaint of the victims, no FIR was issued against them till date, the counsel argued.The bench asked D Prakash Reddy, advocate general of Telangana why the FIR was not issued when the complaint made.

The bench said that as per the law it is the duty of the police officers to issue FIR when he receives a complaint and probe into the matter and then file the final report before the lower court concerned if he finds that the contents of the complaint are proven to be false.Informing the court that they have already suspended a sub-inspector concerned in this case, the AG explained the health condition of the victims to the bench.The bench asked the counsel for the petitioners to file an affidavit explaining the contents of the complaint made against the police officers alleged to have involved in the torture.The bench asked the AG to file the affidavit explaining the reasons for not registering the case against the police personnel and adjourned the hearing.
