Judge Patel's resignation points to flaws in system: K'taka

The Bar Council today said the resignation of Justice Jayant Patel points to "flaws in the system".

A meeting was convened by the Bar Council to deliberate on the "denial to Justice Patel of his rightful and deserved consideration of being appointed or elevated to the Supreme or as chief justice to a high despite being the senior most judge in his parent High of Gujarat".


"The entire legal fraternity is anguished and greatly disturbed by the shaking of confidence in the collegium system, which has meted out such treatment to Justice Jayant Patel, who apparently has satisfactorily discharged his duties and functions as a judge," read a resolution passed at the meeting.

The co-chairman of the Bar Council of and member of special committee, Y R Sadasiva Reddy, signed a copy of the resolution.

Patel was the acting chief justice of the High before being shifted to the High in February 2016.

The judge was reportedly unhappy that he was not made the chief justice of any despite his seniority. The resignation on Monday came amid a reported decision of the SC collegium to transfer him to the Allahabad High

Earlier in the day, Law Minister Ravi Shankar Prasad had said the government had not received any recommendation from the Supreme collegium on transferring Justice Patel from to Allahabad.
