Remember that messy divorce between Katie Holmes and Tom Cruise? Though it happened in 2012, rumors of some rather interesting aspects of their divorce settlement have been flying around ever since. And now, it appears that one of the more bizarre ones—that Cruise asked Holmes to refrain from publicly dating anyone for five years after the end of their marriage—may actually have some merit.

According to the Daily Beast, Holmes and former Men's Health cover guy Jamie Foxx were spotted holding hands on a Malibu beach over Labor Day weekend, with no efforts to shy away from the camera. While this in itself doesn't seem surprising, since people tend to hold hands with people they're in a relationship with, this is the first time the couple has been photographed in public together despite rumors that they have been dating since 2013.

How To Ace Your First Date:

Why the secrecy? It could have something to do with a clause that was said to be part of Holmes and Cruise's divorce settlement; it's said that it was included to prevent Holmes from "embarrassing Tom in various ways." According to the rumor's source, which was reported by gossip site RadarOnline, these "various ways" included "talking about him or Scientology, or publicly dating another man for five years after the divorce."

The source went on to explain that Holmes was not prohibited from dating, but just could not do so publicly. She was also prohibited from bringing a boyfriend near Holmes and Cruise's daughter, Suri. The alleged agreement also said that Suri was not to have any contact with Cruise's religion, Scientology.

If these clauses are true, it'd explain why Holmes and Foxx have been so secretive these past four years and why they suddenly decided to make their relationship public. If not, well, it's just more Hollywood hearsay. As far as Tom Cruise rumors are concerned, however, we're keeping our fingers crossed that this one about a new Top Gun film in the works is anything but questionable.
