The Supreme Court on Monday said that it will hear challenge to the constitutional validity of the provisions of the Unlawful Activities (Prevention) Act used to keep the Students Islamic Movement of India (SIMI) under continuous ban since September 2001.
A bench of Chief Justice Dipak Misra, Justice A.M.Khanwilkar and Justice D.Y.Chandrachud directed the hearing of the challenge to the provisions of the 1967 security act on October 13.
The petitioner is contesting increasing the duration of ban from earlier two years to five years.
Humam Ahmad Siddiqui, a former SIMI member, had challenged the constitutional validity of these provisions and the apex court had on May 7, 2012 issued notice to the Centre on his petition.
The petitioner have contended that the provisions of the said Unlawful Activities (Prevention) Act, are not only intrinsically flawed but the manner in which they are operationalised by the central government go on to breach of the Constitution's Articles 14, 19 and 21.
On May 2, 2014, the top court had referred to a larger bench the plea challenging the ban on SIMI, saying it would hear the challenge to the law in the course of the hearing of a batch of petition challenging the provisions of law as well as ban on the SIMI.
