The Madurai Bench of the Madras High Court on Tuesday dismissed activist ‘Traffic’ Ramaswamy’s petition seeking the dismissal of the State government, which he alleged was corrupt, by the Governor.
A Division Bench of Justices K. K Sasidharan and G. R. Swaminathan observed that the affidavit filed by the petitioner had no materials supporting his arguments and as the Chief Minister and the Council of Ministers enjoyed the confidence of the majority of the house there was no need to suspend the Assembly.
The court observed that the Governor, though has the power to summon the House, has no overriding authority over the representatives of the State Legislature when the Chief Minister and the Council of Ministers enjoy the confidence of the majority of the House. The Governor has powers only when the confidence of the majority is lost.
On the contention of the petitioner that a full-time Governor should be appointed for Tamil Nadu, the court observed that though it was genuine, the petitioner had not made any representation to the Central government and without submitting representations to the concerned authorities it was not possible to issue directions in the issue. The petition was dismissed without costs.
