Setting aside controversial Public Safety Act (PSA) against a detainee, the Jammu and Kashmir High Court on Saturday underlined that the “rhetorical incantation of the words ‘goonda’ or ‘prejudicial to maintenance of public order’ cannot be sufficient justification to invoke the draconian powers of preventive detention”.
Justice Ramalingam Sudhakar and Justice M.K. Hanjura set aside the PSA order of District Magistrate, Shopian, and directed the release of Tariq Ahmad Ganai alias Maqdam.
