NGO accuses cab providers of violating IPC, Motor Vehicles Act

A Delhi court on Monday summoned app-based cab service providers Ola, Uber and Taxi For Sure on a complaint filed by a non-government organisation — Nyayabhoomi.

The cab service providers have been accused of violating provisions of the Indian Penal Code and the Motor Vehicles Act.

Metropolitan Magistrate Abhilash Malhotra has now directed ANI Technologies Pvt. Ltd., Uber India Systems Pvt. Ltd. and Serendipity Infolabs Pvt. Ltd. — which operate Ola, Uber and Taxi For Sure respectively — to have their authorised representatives appear before the court on December 1.

In June, the court had recorded pre-summoning evidence of the complainant.

The NGO had alleged, among other things, that facilitating vehicles with tourist permits registered in Delhi and other States to ply and provide services on point-to-point basis was a violation of the law.

Monetary loss for govt

Further, many of these vehicles were running on diesel in violation of Supreme Court orders and charging passengers in violation of the fares notified under Section 67 of the MVA, which was a breach of permit conditions.

They were charging passengers using mobile apps, when the permit conditions and rules stipulated that fares should be based on the meters fitted in the vehicles.

So far, the government had cumulatively lost around ₹91,000 crore from 2013 to 2016 by not registering cases and issuing challans against these vehicles, the complaint added.
