The Maharashtra government today moved the Bombay High Court against the court's stay to increase Floor Space Index (FSI) for a 'cluster redevelopment scheme' in the neighbouring Navi Mumbai.
In 2014, the government proposed to increase FSI for new buildings under the cluster redevelopment scheme, so as to allow private developers to redevelop slums and dilapidated buildings into buildings as high as 60-storey.
But the high court, in response to a public interest litigation, stayed the proposal in September 2014. The PIL contended that the government had not conducted any impact assessment study.
The government today filed an application before a division bench of Chief Justice Manjula Chellur and Justice N M Jamdar, seeking lifting of the stay.
Navi Mumbai Municipal Corporation and the state planning body CIDCO had carried out impact assessment study and confirmed that the increase in FSI will not have any adverse impact, it said.
Occupants of several dilapidated buildings in Navi Mumbai do not have the resources to carry out redevelopment on their own, and therefore cluster redevelopment (redevelopment of several building together) was needed, said the government pleader Abhinandan Vagyani.
Increased FSI would be an incentive for builders, he said. The court posted the application for hearing on June 9.
