The Supreme Court on Monday refused to hear a plea by Calcutta High Court judge Justice C S Karnan for staying his arrest to serve a six-month jail term in a contempt case.
A five-judge bench headed by Chief Justice J S Khehar warned advocate Mathews J Nedumpara, appearing for Justice Karnan, against wasting the court’s time.
“You are wasting our time. We will hear the petition when it comes to us,” the bench told Nedumpara, who sought an urgent hearing on a writ petition.
The counsel sought listing of the petition filed by Justice Karnan against the apex court’s May 9 order. The court had then held Justice Karnan guilty of contempt and sentenced him to six months’ imprisonment.
Justice Karnan had earlier contended that the apex court’s Registry was not admitting his writ petition against the May 9 order.
The judge, who could not be traced, has challenged the Constitutional validity of the Contempt of Courts Act. He claimed contempt of court proceedings could not be instituted against a judge.
