The High Court of Karnataka on Wednesday quashed the proceedings against a Ugandan national after he produced the air ticket that he has bought to fly back to his country.
Junia Erastus Mayemba, a Ugandan national, had approached the high court seeking quashing of the case filed against him for overstaying in the country. The petitioner has contended that he came to India on a student visa and was studying BCom at Sri Omkar College for Commerce and Management.
A letter was written by the Foreigners Regional Registration Officer (FRRO) to the Bagalur police to take action against Junia for over overstaying in the country.
His visa expired on May 13, 2014. To renew his visa, he approached the FRRO wherein a letter from the college was required. Much later, the Ugandan national learnt that his college was not recognised by the Government of Karnataka.
Junia has contended that he had overstayed as his college cheated him. Earlier, Justice Anand Byrareddy had asked Junia to produce the air ticket in the next hearing. After the air ticket was produced on Monday, the judge quashed the proceedings against him.
