CCI rejects complaint against Abbott Healthcare

The Competition Commission has dismissed allegations of unfair business practices made against Healthcare with respect to supply of medicines.

A city-based wholesaler of pharmaceutical products had alleged that the company violated competition norms by refusing to supply medicines to it and also abused the dominant position.



While rejecting the complaint, CCI said Healthcare has "sufficient commercial reasons for not supplying the medicines" to the informant and its refusal cannot be held to be in violation of Section 3.

Section 3 of the Competition Act pertains to anti- competitive agreements.

"There is no specific information available in the public domain to suggest that the Opposite Party (Healthcare) is dominant in any particular market," Competition Commission of (CCI) said in an order on Wednesday.

The regulator also noted that the firm did not receive any complaint with respect to "shortage or non-availability of its medicines" and that the existing stockists have been able to make effective supply to the consumers.
